Description of Mark: Color is not claimed as a feature of the mark. The mark consists of a design, not being a configuration of goods or packaging, the literal element "finax" above "MÜSLI" appearing on a representation of a cloth tag or label, which includes a small representation of a head of grain above the word "FINAX". The label design is imposed over a graphic representation of a rectangular package with rounded edges, the background of which is a darker field which includes a checked pattern. Two horizontal lighter stripes extend along the top of the field, and one vertical stripe on the left side of the field. Three horizontal darker stripes appear, one directly above the first horizontal lighter stripe, one between the two horizontal lighter stripes, and one at the bottom crossing the bottom of the cereal bowl representation. One vertical darker stripe appears down the left edge of the rectangular box design. The two sets of stripes cross each other in the upper left quadrant of the checked field. In the lower half of the field is a representation of a bowl, containing cereal and/or muesli in milk, with a representation of a spoon on the right hand side of the bowl at about the "4 o'clock" position. The handle of the spoon extends over the edge. The stippling and lining of the mark are features of the mark, meant to impress upon the consumer the idea of a kitchen towel, such as towels which are used while baking.
